Although the automobile recall system was established on March 15 this year, the related "Three Guarantees" policy for vehicles has been delayed. However, a few days ago, reporters learned from reliable sources that China’s auto "Three Guarantees" policy has now been finalized and is awaiting final approval from the relevant authorities. According to an insider, if no unexpected issues arise, the "Three Guarantees" policy is expected to be officially launched on October 1st. To ensure a smooth implementation of the defective vehicle recall system on that date, the General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) has recently released four sets of supporting measures for the "Regulations on the Management of Defective Automobile Recalls." These include guidelines for information systems, expert databases, investigation procedures, and supervision mechanisms. In addition, AQSIQ will conduct various promotional activities to raise awareness among consumers and manufacturers. The "Three Guarantees" policy, which covers repair, replacement, and refund, has long been absent for automobiles, which are considered high-value products. However, with the rapid increase in car ownership and consumer complaints over recent years, the need for such a policy has become urgent. Although some manufacturers have already initiated voluntary recalls, the implementation of the "Three Guarantees" regulation is seen as the most pressing step in resolving current consumer disputes and protecting individual rights. Industry analysts point out that while the recall system is in place, the real challenge lies in implementing the "Three Guarantees" effectively. Data from the National Consumers Association shows that in 2003, there were 5,651 vehicle-related complaints—up 44.2% from 2002. In Shanghai alone, vehicle complaints rose by 107.33% compared to the previous year, highlighting the growing demand for better consumer protection. One major challenge of the "Three Guarantees" policy is how to handle situations where consumers have already paid taxes or licenses. While government departments have proposed solutions, many companies are reluctant to replace vehicles, often using it as an excuse to avoid responsibility. Once the policy is implemented, these companies will have no choice but to comply. In preparation for the policy, the Ministry of Public Security and the State Taxation Administration issued new regulations last year. For example, if a car's license plate needs to be changed due to quality issues, the manufacturer must prove that the owner can do so without additional costs. Similarly, tax refunds for returned vehicles can be processed based on the manufacturer’s certificate. Despite these developments, challenges remain. Industry insiders note that the "Three Guarantees" policy appears to have been drafted primarily with manufacturers in mind, rather than consumers. Additionally, imported cars are reportedly excluded from the policy. Another key issue is determining who will assess the quality of a vehicle. Currently, only a limited number of testing agencies exist, and the process is costly and complicated. Most quality assessments are still conducted by the manufacturers themselves, raising concerns about objectivity and fairness. To address these issues, AQSIQ has issued four supporting measures to enhance the standardization and practicality of the recall system. These include guidelines for managing the recall information system, establishing an expert database, conducting investigations, and supervising the recall process. Before the official launch, AQSIQ will also provide free training for industry professionals, covering legislative background, definitions, and company response strategies, to ensure a smooth transition and effective implementation of the system.
